If You Have Borrowed from Sallie Mae Please Read Immediately: Arthur, et al. v. Sallie Mae, Inc.

If your lender is Sallie Mae, I encourage you to read this page carefully. One of my readers sent it to me, and I wish to thank them for that. There might be a settlement against Sallie Mae. Here are a few details about possible class members:

You may be a Class Member if, on or after October 27, 2005 to September 14, 2010, you received a call to a cellular telephone through the use of automated telephone equipment from Sallie Mae or any other affiliate or subsidiary of SLM Corporation.

I read the proposal, but it's not clear what's at issue. Is it that Sallie Mae is eating up cell phone time, for which we are ultimately charged? Or does the class suit contend that getting calls on the cell is inconvenient in some way?

I actually opted for communication only via cell rather than home because I didn't like my parents getting all those calls.

That's a good question. It's not clear to me after reading the document. Perhaps it is a case of Sallie Mae eating up cell phone time, because the largest one might receive is around $500. Most members will only received $15-$40, and they can't pursue further legal action against Sallie Mae.

It is my understanding after reading everything on the web site that you can pursue further action against SM even if you collect on this suit. You just can't pursue any further action specifically regarding cell phones. Any other type of action is not included in this settlement, therefore further legal suits against SM for other types of violations is fine.

The class action suit contends that unsolicited, non-emergency phone calls by automatic telephone dialing systems is a violation of the Telephone Consumer Protection Act, 47 USC. Without admitting wrongdoing, SM has proposed a settlement of $19.5 million dollars. The beauty of this suit is that SM's victims will now understand that SM can be held accountable for its sins.

As with most class action lawsuits, the only ones that will make money are the lawyers and/or firm bringing the suit.

100 bucks might buy a decent pair of shoes.

500 bucks might buy shoes and a few other items, but not much.

I opted out. By staying part of it, you acknowledge that you accept the 40 bucks and can never sue them again.

Screw that. I WILL find an angle to sue them and I WILL get justice for it.
