Quick post on HUGE news - Court sides with debtor in student loan case
The text of the opinion will not be published for several months, in the “sacred” U.S. Reports. But, going off this brief article, it looks like this is a small victory for students. It looks like this will benefit students who file bankruptcy – and claim their student loans – IF the lender does not object at the hearing.
That being said, I am very happy for Francisco Espinosa. Presumably, he went to school in the 1980s, when student loans were dischargeable – and when tuition was MUCH more affordable. The real test will be when a recent college graduate goes to court, as student debt is no longer dischargeable in bankruptcy.
